Regulations and Laws on Employee Relocation

from:

As the economy becomes far more global, there are more and more people every year who require not only relocation services but also, advice pertaining to laws on employee relocation. Generally these are federal laws that pertain to the entrance of foreign nationals into the country on short or long-term work visas. However, any time there are families and real estate involved, there are legal issues that could use the helpful touch of an attorney that specializes in such things.

For starters: the visa process. Your company will have to prove that the foreign born employees you're importing are your only option. A great many work visas depend upon some sort of affidavit or proof that there are no US citizens qualified for the position. The regulations that pertain to visas are the most rigorous of the laws on employee relocation. There certainly is no way around them and failure to comply is a federal offence. It is up to your company, to make sure all employees who are working on visas have been thoroughly researched and everything that can be done to support the federal visa process has been done.

When researching the laws on employee relocation, one may find family law to be a highly correlated subject. Whether moving from around the world or the next state over, taking children who the travelling parent doesn't have sole custody over is a very serious offence. Though it is certainly not your firm's responsibility to make sure every family member who travels is not there against their will, it is certainly prudent to perform some sort of background check.

Because of of this, it would behove your company to be particularly careful when courting prospective employees from countries that the US is openly hostile to. While there are no actual laws on employee relocation that forbid residents of certain countries to work here, is is certainly wise to make sure your newest employee is exactly who they say they are. It's not very nice among polite company, but for the sake of business, it must be done.

Those who actually are working for the State Department as part of the diplomatic core are subject to far more investigation and interrogation as per the existing laws on employee relocation, not matter where they're from.

Lastly, there seem to be far fewer laws on employee relocation in communities where covert operations are common place. In places such as Washington DC and the surrounding countryside, which just happens to be full of people from other places, the most vexing legal problem you're likely to run into after the visa application is simple titles and deeds to the old or new home.

Regardless, no matter how well you plan, it's always good to have a knowledgeable attorney in the back
